Giving a name for a newly incorporated company may be one of the first things that business (Also see Errors That You May Commit When Recording Business Transactions) owners would do when they set up a new firm. However, they may not know that there are some prohibitions and rules that they need to follow when they apply for the company (Also see An Overview of Private Company) name. In this article, we are going to discuss some guidelines about the naming of a company.

Firstly, you need to make sure that you have used correct spellings and language in your company’s name. If there are words that are in languages other than Malay or English in the name, you need to give the meaning of those words. Also, you have to make sure that the names are not blasphemous and are most probably not offensive to the public. You should not include words that contain the elements of religion in the company name too.

When giving a name for your company, you need to make sure that the names are not too general, such as naming your company as “Beautiful Sdn. Bhd.”. If you want to use the name of a person as the company name, the name should be from the names of the directors that you have mentioned in the company constitution (formerly known as M&A).  However, if the name comes from the immediate family of the director, like his grandmother, father, wife or children, the name can be considered. In this case, the director needs to provide evidence on the family relationship. If the company (Also see Changing from Private Companies to Public Companies or vice versa) name that you applied is from the name of an existing group of companies, you must get a consent letter from that group of companies.

In the application, you should also indicate the meaning of the words you created. Apart from that, make sure that the name of the company is not an acronym which people may feel confused between the name of multinational corporations like IBM and ICI.
